These Terms of Service ("Terms") govern your use of the Buongiorno Marya service provided by Buongiorno Docklands Ltd ("we", "our", "us"). By ordering or using our service, you agree to these Terms.
1. Service Description
Buongiorno Marya is an AI-powered email assistant service designed specifically for language schools. The service includes:
- AI-powered email response generation
- Multilingual support (English, Italian, French, Spanish, Portuguese)
- Automatic follow-up emails
- Customizable knowledge base and communication style
- Hosting, maintenance, and technical support
2. Pricing and Payment
Standard Pricing
- Setup Fee: €499 (one-time, non-recurring)
- Monthly Service Fee: €149 per month (billed monthly)
VAT: All prices are exclusive of VAT. VAT will be added to your invoice based on your country of residence. EU businesses with a valid VAT number may be eligible for reverse charge.
Payment Terms
- Setup fee and first month's service fee (€648 total) are due upon order confirmation
- Monthly fees are billed in advance on the 1st of each month
- Payment accepted via bank transfer or invoice
- Late payments may result in service suspension after 14 days
3. Money-Back Guarantee
7-Day Full Refund
If you are not satisfied with the service for any reason within 7 days of going live, we will refund 100% of all fees paid (setup + monthly).
30-Day Setup Fee Refund
If you cancel within 30 days of your order, we will refund the full €499 setup fee. You will only be charged for the monthly service used (€149).
Refund Process
To request a refund, email us at marya [at] fanara [dot] eu. Refunds will be processed within 14 business days.
4. Cancellation Policy
You May Cancel Anytime
- No long-term contract required
- Cancel by emailing us at least 7 days before your next billing date
- Service continues until the end of your current billing period
- No refunds for partial months unless within guarantee periods above
We May Cancel If:
- Payment is more than 30 days overdue
- You violate these Terms
- You use the service for illegal or harmful purposes
5. Included Services
Setup (One-Time)
- Configuration document preparation
- Human quality checks
- Pre-deployment review
- 1-2 weeks hands-on support
- Review mode testing (10-20 emails minimum)
- Fine-tuning based on your feedback
Monthly Service
- Hosting and maintenance
- Unlimited emails processed
- 1 AI agent included
- 1 configuration review per month
- 1 small change per month (e.g., pricing updates, new offers)
- 99.5% uptime guarantee
- Email support (response within 48 hours)
- Daily backups
- GDPR-compliant data handling
6. Your Responsibilities
You Agree To:
- Provide accurate information for configuration
- Maintain valid email credentials for the AI agent
- Review and approve the knowledge base before going live
- Monitor emails during the review period
- Notify us promptly of any issues or inaccuracies
- Use the service only for legitimate language school enquiries
You Agree NOT To:
- Use the service for spam, phishing, or illegal activities
- Attempt to reverse-engineer or copy the service
- Share your service access with other organizations
- Use the service to send unsolicited marketing emails
7. Uptime and Service Level
99.5% Uptime Guarantee
- We guarantee 99.5% uptime per month (excluding scheduled maintenance)
- Scheduled maintenance will be announced at least 48 hours in advance
- If uptime falls below 99.5%, you receive a pro-rata credit for that month
Excluded Downtime:
- Scheduled maintenance
- Issues caused by your email provider
- Issues outside our control (internet outages, DNS failures, etc.)
8. Data and Privacy
Your data is handled according to our Privacy Policy. Key points:
- Email interactions are processed by Anthropic's Claude API
- We store email logs for 12 months
- You own all your data and can request export at any time
- We comply with GDPR and other data protection regulations
- Upon cancellation, your data is deleted within 30 days
9. Intellectual Property
- You own your knowledge base content and email data
- We own the Buongiorno Marya software, code, and brand
- You may not resell or white-label our service without written permission
10. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for any indirect, incidental, or consequential damages
- Our total liability is limited to the fees you paid in the last 12 months
- We are not responsible for the accuracy of AI-generated email responses
- You are responsible for reviewing AI responses before auto-send is enabled
11. AI Response Disclaimer
Important: Buongiorno Marya uses artificial intelligence (Anthropic's Claude) to generate email responses. While we strive for accuracy:
- AI may occasionally generate incorrect or inappropriate responses
- You should review responses during the setup period
- We recommend monitoring emails regularly even after going live
- We are not liable for business loss due to AI errors
- You can switch to review mode at any time to manually approve all emails
12. Modifications to Terms
We may update these Terms from time to time. If we make material changes:
- We will notify you by email at least 30 days in advance
- You may cancel without penalty if you don't agree to new terms
- Continued use after changes means you accept the new terms
13. Governing Law
These Terms are governed by the laws of Ireland. Any disputes will be resolved in Irish courts.
14. Enterprise and Custom Plans
Enterprise customers with multiple agents or custom requirements may have separate agreements that supersede these standard Terms.
